As yet another new law with major implications for business owners, the Prevention & Combating of Corrupt Activities Act, stipulates that all instances of corruption must be reported to the police.
For honest business owners, who often come across suggestions and hints from corporate and government officials for kickbacks and bribes, it means that such unsavoury experiences can no longer just be ignored. It is a criminal offense not to report them. Also, failure to report a case of fraud or theft exceeding R100 000 to the police is from now on a criminal offence.
It often happens that business owners who uncover major fraud by one of their employees simply let the employee go in order to avoid messy court cases and CCMA wrangles that take their focus away from their businesses. Well, they no longer are allowed to do that. All such cases must be reported to the police.
According to the online labour advice service for business owners, Labourwise, the new Act prescribes severe penalties, including life imprisonment for certain transgressions.
